Monday (December 2) the Supreme Court refused to hear a case filed by Amazon and Overstock.com Inc., claiming the New York State Law requiring them to collect taxes was unconstitutional.
Under the law, any e-commerce site that has a store presence in the state is required to charge a sales tax. This provided a loophole for sites like Amazon and Overstock, which strictly operated online. It’s a major victory for brick-and-motor stores who felt they were at an unfair disadvantage to these e-commerce sites by having to collect taxes.
According to WWD, the High Court issued its decision on Monday without comment.
